USER RESPONSIBILITIES FOR USE AND CONTENT

Both the access to the web sites and the use to which the information and content therein can be put will be the exclusive responsibility of the user.

Users are obliged to make reasonable use of the services and content on the principle of good faith and in accordance with the law, morals, public order, good custom, respecting a third party’s rights and those of the INC, in line with the possibilities and objectives for which they were intended. The INC does not accept any responsibility, neither directly nor indirectly, for any damage caused or any loss of profit as a result of an inappropriate use of the services or content on the part of the user or third party.

INFORMATION RE THE LAW OF ELECTRONIC COMMERCE

The INC declines any responsibility if there is any interruption to or malfunction of the services or content offered on the internet, whatever the cause. Nor does the INC accept any responsibility for any technical failure on the internet, any loss of profits as a result of such failure, electricity cuts or any other indirect damage which the user may suffer due to causes outside the control of the INC.

The INC does not declare nor guarantee that the services or contents will be available, nor that they will be error free, nor that any fault will be publicised or that the server will be free of virus and other harmful elements, despite the INC’s best efforts to avoid this type of incident. If the user takes a decision or action based on the information included on any of the web sites, the checking of such information from other sources is recommended.

INDUSTRIAL AND INTELLECTUAL PROPERTY

Both the contents provided by the INC and those published on its web pages constitute a work as contemplated in the intellectual property legislation and, therefore, are protected by the corresponding laws and international agreements.

Any form of reproduction, distribution, public communication, transformation, dissemination and generally any other action of public exploitation of either the web pages or their content or information is strictly prohibited without the express and previous written consent of the INC.

Consequently, all the content of our various web sites, and specifically designs, texts, graphics, logos, icons, buttons, software, commercial names, brands, industrial drawings or anything else susceptible to an industrial or commercial use, is subject to the industrial and intellectual property rights of the INC or of their third party owners who have granted the necessary authorisation to include them in our various web sites.

The contents, images, forms, opinions, index and the other formal expressions which may form part of the web pages, along with the software necessary for them to work and be visualised, also constitute artists’ works and are, therefore, protected by international agreements and national legislation in relation with intellectual property rights. The INC is free to limit access to its web pages and to the products and/or services offered therein, as well as to restrict publication of opinions, observations, images or comments which users may send by email.

The INC may, notwithstanding the sole and exclusive responsibility of the users, put in place the filters necessary to prevent the publication via its web pages of content or opinions considered racist, xenophobic, discriminatory, pornographic, defamatory or which in any way encourage violence or the dissemination of content which is clearly illicit or harmful.

It is understood that those users who send their suggestions, observations, opinions or comments by email to the INC’s web pages, even when they may expressly state the opposite, are thereby authorising their reproduction, distribution, exhibition, transmission, retransmission, broadcast in any form, physical or logical storage (e.g. on diskettes or computer hard disks), digitalisation or dissemination from databases belonging to the INC, as well as their translation, adaptation, modification or any other transformation of observations, opinions or comments for the period stated in the protection of authors’ rights legislation.

In accordance with what is stated in the previous paragraph, the INC is authorised to modify or alter any observations, opinions or comments such as these in order to adapt them to the needs of the editorial format of the web pages; such changes, however, will not affect any authors’ rights which the users may have.

Any technical, logical or technological resource by which a third party may benefit, directly or indirectly, with or without profit, from any of the contents, forms, indexes or any of the other formal expressions which form part of the web pages or from the work invested by the INC in their operation is strictly prohibited. Specifically, any link, hyperlink, framing or similar which may be made to the INC’s web pages is forbidden without the prior, express, written consent of the INC. Any transgression of that outlined in this point will be considered an infringement of the INC’s legitimate intellectual property rights over the web pages and all their content.
